Police have found potentially incriminating evidence in Sandy Rubenstein’s swanky apartment — a sex toy.

Now investigators are checking whether the device was used to brutally violate the woman who has accused the civil rights lawyer of rape, sources said Tuesday.

The shocking development came as Rubenstein was spotted out at the Hamptons, dressed in jogging gear with his silvery mane disheveled — and looking nothing like the media-savvy operator in $1,000 suits that is his usual public image.

“I will not comment on any aspect of the investigation or any of the alleged facts reported in the press, even those I know to be patently false,” his lawyer, Benjamin Brafman said, when asked about the sex toy.

“I stand by what I have said from the beginning. When a thorough and complete investigation is concluded, no criminal charges will be filed against Mr. Rubenstein because he did not commit any crime whatsoever.”

A short time later, Rubenstein left his Hamptons pad in his usual getup — an expensive, cream-colored suit — and drove off to Brafman’s office in Manhattan. He refused to answer any questions when he got there.

Rubenstein, 70, split from the city Monday as police were searching his Upper East Side penthouse for potentially incriminating evidence.

His 42-year-old accuser says she awakened from a drunken stupor to find the lawyer assaulting her and investigators were checking her claims that Rubenstein penetrated her with an object of some kind.

Cops are now checking the device — and the condoms, some of them bloody, that were found near the lawyer’s bed — to see if the woman’s DNA is on them, sources said. She was bleeding when a rape kit was administered at the hospital.

The News is not identifying the woman, who is a business executive and high-ranking official at the Rev. Al Sharpton’s National Action Network.

Her face covered by dark clothing, the mom was spotted Tuesday leaving the Manhattan District Attorney’s office holding a booklet entitled “After Sexual Assault: A Recovery Guide for Survivors.”

“She is doing as well as can be expected under the circumstances,” her father said outside his New Jersey home. “This has been traumatic for her and traumatic for us.” Everything is under investigation, that is all I can say.”

Meanwhile, a knowledgeable source who has seen security video from Rubenstein’s building taken on the night of the alleged rape said that — contrary to earlier reports — the accuser showed no sign of being intoxicated and needed no help walking.

“The video will exonerate him,” the source said of Rubenstein.

Police sources had reported earlier that the woman appeared “out of it” in the footage detectives had obtained.

In a statement, the accuser’s lawyers said “that footage sheds no light on whether Mr. Rubenstein sexually assaulted the victim and is silent on the issue of what happened inside of that apartment.”

“Like many of the leaks in this investigation, it’s an intentional effort to discredit the victim and try the case in the court of public opinion,” the lawyers, Keith White and Kenneth Montgomery, said.

Rubenstein, a longtime nemesis of the NYPD, decamped for the Hamptons after White announced on Monday they have “devastating” information against the high-powered lawyer.

White did not divulge any details but said the female friend who was with the accuser at Rubenstein’s E. 64th St. apartment before the alleged attack is “completely cooperative.”

Rubenstein contends they had consensual sex at his $7 million penthouse pad. And when they woke up the next morning, a source close to Rubenstein claims, they had sex again.

Police, however, are investigating allegations that Rubenstein took advantage of the woman Wednesday when they returned to his apartment from Sharpton’s 60th birthday bash.

Investigators are treating the case as a possible third-degree rape, meaning the alleged victim was incapable of giving consent, sources said.

Earlier, police tried to trick Rubenstein into implicating himself by having the accuser make a “controlled call” during which she asked, “What happened last night?”

Rubenstein replied that they had sex, but said nothing “incriminating,” a police source said.

The explosive charges have put Sharpton in a predicament because he and Rubenstein have worked together in legal battles against the Police Department.

Not only is Rubenstein a member of the National Action Network, he and Sharpton have often stood arm in arm at protests. And among other high-profile cases, Rubenstein represents the family of Eric Garner, who died after a cop put him in a chokehold on Staten Island in July.

Sharpton has met with the Garner family to reassure them that they remain committed to the case.

The investigation could also drag in some of the bold-faced names who were at the Sharpton bash, like Mayor de Blasio and Gov. Cuomo, director Spike Lee and singer Aretha Franklin.
